Terms of Use

Last updated: 28 October 2026

1. About these terms and who we are

These terms of use apply when you visit or use theexfiles.co.uk (the “website”). By using the website, you agree to these terms. If you do not agree, please do not use the website.

The Ex Files is the trading name of Rachael Amelia Harwin, a sole trader. “We”, “us” and “our” mean that business. Our services are delivered by Rachael Amelia Harwin, an individually regulated solicitor. The business provides unreserved legal services and is not an SRA-authorised firm.

These terms cover general use of the website only. If you buy one of our services (Know Your Position, Check Your Deal or Make It Legal), our Terms of Business will also apply to that service. If the two conflict, the Terms of Business take priority for the service you have bought.

2. Information only, not legal advice

The content on the website, including articles, service descriptions and guidance, is general information about family law in England and Wales. It is not legal advice and does not take account of your circumstances. You should not rely on it as a substitute for advice about your own situation.

Using the website, sending an enquiry or requesting the Free Divorce Guide does not make you our client and does not create a solicitor–client relationship. That relationship only starts when you buy a service and we confirm we can act for you, under our Terms of Business.

The law and court procedures change. We aim to keep the website up to date, but we do not promise that every page reflects the current position on the day you read it.

3. The Free Divorce Guide

The Free Divorce Guide is a free, automated information service. You answer a short questionnaire and we email you a PDF made up of general sections chosen by your answers.

  • The guide is general information, not legal advice. It has not been reviewed by a solicitor for your case.
  • It is only as accurate as the answers you give. We do not check them.
  • It is intended for people who may be eligible to divorce in England and Wales. If the guide says it cannot confirm your eligibility, that is not a court decision; take legal advice where you have a connection with another country.
  • Requesting the guide does not make you our client or reserve a service.

You must give an email address you are entitled to use. We use it as described in our Privacy Policy. If you think the guide has shown you the wrong sections, email us and we will look at it.

4. Using the website

You may use the website for your own personal, lawful purposes. You must not:

  • give false details about yourself or anyone else, or use another person’s email address without their permission;
  • try to get into parts of the website, accounts or systems you are not authorised to use;
  • introduce viruses or other harmful code, or overload, disrupt or damage the website;
  • use automated tools to copy, scrape or harvest content or data from the website;
  • use the website to harass anyone, or to find out information about another person for an improper purpose;
  • send us anything that is unlawful, defamatory or offensive.

We may suspend or block access to the website, or to any form or feature on it, if we reasonably believe these terms have been broken. Where a breach may be a criminal offence, we may report it to the relevant authorities.

5. Accessibility

We want everyone to be able to use this website. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.2 at level AA.

Some parts may not be fully accessible yet:

  • PDF documents, such as the free guide and the copy of your financial questionnaire, may not work fully with all screen readers.
  • Payments are taken on Stripe’s secure payment page, and appointments take place on Microsoft Teams. These are provided by other companies, and we can’t control how accessible they are.

If you have difficulty using any part of the website, or you need information in another format (for example large print, a Word document, or a phone or video call instead of a form), please email us at info@theexfiles.co.uk. Tell us what you need and how best to contact you, and we’ll do our best to help.

6. Intellectual property

We own, or are licensed to use, the content of the website. That includes the text, guides, the Free Divorce Guide, the design, graphics, and The Ex Files name and logo.

You may view, download and print pages, and keep your own copy of your Free Divorce Guide, for your personal use. You must not copy, republish, sell or adapt the content for any commercial purpose, or remove our name from it, without our written permission.

7. Links, availability and security

Links to other websites. The website links to other sites, such as GOV.UK and our social media pages. We do not control those sites and are not responsible for their content or how they handle your information.

Availability. The website is free to browse. We do not promise that it, or any part of it, will always be available or uninterrupted. We may change, suspend or withdraw any part of it, for example for maintenance.

Security. We take reasonable steps to keep the website secure, but no website is completely free of bugs or viruses. Please use your own virus protection. Keep any account details private, and tell us straight away if you think someone else has used them.

8. Our liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or your rights as a consumer that cannot be excluded.

Subject to that:

  • The website and the Free Divorce Guide are provided free of charge, as general information. We are not liable for any loss arising from your reliance on general website content or the Free Divorce Guide, rather than on advice about your own circumstances.
  • We are not liable for loss or damage caused by a virus or other harmful material that reaches your device through your use of the website, where we have taken reasonable care.
  • We are not liable for the content of websites we link to.
  • The website is for personal use. We are not liable for any business losses, such as loss of profit or business opportunity.

Our liability for paid services is set out in our Terms of Business.

9. Privacy, changes, law and contact

Your information. Our Privacy Policy explains how we use personal information you give us through the website, including the Free Divorce Guide and enquiry forms. The website uses only the cookies needed for it to work, such as keeping you logged in and remembering your basket.

Changes to these terms. We may update these terms from time to time, for example to reflect changes to the website or the law. The version on the website when you use it applies, so please check this page from time to time.

Law and courts. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

Contact and complaints. If you have a question or concern about the website, email info@theexfiles.co.uk or write to Office 171956, PO Box 7169, Poole, BH15 9EL.
